USCIS has announced on its Visa Bulletin web page that the agency will accept employment-based adjustment of status applications based on the Final Action Dates chart  and family-based adjustment of status applications based on the Filing Dates chart in July.

  • EB-1: China will advance by 2 months to June 1, 2023. India will retrogress by 2 months to October 15, 2022.  Other countries will continue to be current.
  • EB-2: China will remain at September 1, 2021. India will continue to be unavailable. All other countries will continue to be current.
  • EB-3 Professionals and Skilled Workers: China will advance by almost 5 months to December 22, 2021. India will advance by 2 weeks to January 1, 2014. The Philippines will remain at August 1, 2023. Other countries will advance by 2 months to August 1, 2024.
  • EB-5: For Unreserved categories, China will advance by more than 2 months to December 1, 2016. India will remain unavailable. All other countries will remain current. The EB-5 set-aside categories (Rural, High Unemployment, and Infrastructure) will also remain current.

    EMPLOYMENT-BASED CATEGORIES

    The employment-based (EB) categories in the Visa Bulletin are as follows:

    An applicant’s priority date is the day that the government receives the employer’s PERM application. If a PERM application is not required, the priority date is the date the government receives an EB visa petition (Form I-140 or Form I-526).

    FAMILY-BASED CATEGORIES

    The family-based categories in the visa bulletin are as follows:

    An applicant’s priority date is the day that the government receives the I-130 Petition. Watch our family-based video to see various methods of shortening your waiting time for a green card.

    The word “Current” in the Visa Bulletin indicates that no backlog presently exists in a particular category. Alternately, “U” or the word “Unavailable” indicates that it is not possible to apply for permanent residence in that category.

    B. FAMILY-SPONSORED FILING DATE CHART – The chart below reflects dates for filing visa applications within a time frame justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the application date in the chart may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions.

    The application date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa.
