The Dates for Filing cutoff dates govern when a foreign national may be eligible to submit an adjustment of status application to USCIS in April.

Movement in the Family-Based Dates in April

  • F-1: Mexico will advance by almost 2 months and the Philippines by 2 months. All other countries will advance by almost 6 months.
  • F-2A: No movement
  • F-2B: Mexico will remain frozen while the Philippines will advance by over 3 months. All other countries will advance by almost 6 months..
  • F-3: Mexico will remain frozen while the Philippines will advance by 4 months. All other countries will advance by over 3 months.
  • F-4: Mexico and India will remain frozen while all other countries will advance by 5 months.

Movement in the Employment-Based Dates in April

  • EB-1: China and India will advance by 1 month to April 1, 2023. All other countries will continue to be current.
  • EB-2: China will remain at September 1, 2021, and India will advance by 10 months to July 15, 2014. All other countries will become current.
  • EB-3 Professionals and Skilled Workers: China will advance by 6 weeks to June 15, 2021. India and Philippines will remain at November 15, 2013, and August 1, 2023, respectively. All other countries will advance by 8 months to June 1, 2024.
  • EB-5: For the EB-5 Unreserved categories, China will advance by 2 weeks to September 1, 2016. India will remain at May 1, 2022. All other countries will remain current. The EB-5 set-aside categories will also remain current.

    EMPLOYMENT-BASED CATEGORIES

    The employment-based (EB) categories in the Visa Bulletin are as follows:

    An applicant’s priority date is the day that the government receives the employer’s PERM application. If a PERM application is not required, the priority date is the date the government receives an EB visa petition (Form I-140 or Form I-526).

    FAMILY-BASED CATEGORIES

    The family-based categories in the visa bulletin are as follows:

    The word “Current” in the Visa Bulletin indicates that no backlog presently exists in a particular category. Alternately, “U” or the word “Unavailable” indicates that it is not possible to apply for permanent residence in that category.

    B. FAMILY-SPONSORED FILING DATE CHART – The chart below reflects dates for filing visa applications within a time frame justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the application date in the chart may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions.

    The application date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa.
