Hemos representado a cientos de empleadores en todo Estados Unidos, ayud\u00e1ndoles a patrocinar empleados tanto para visas de trabajo temporales como para tarjetas verdes.<\/p>\n<p>La ley de inmigraci\u00f3n de Estados Unidos permite que 140,000 personas al a\u00f1o obtengan tarjetas verdes a trav\u00e9s del empleo. Este n\u00famero incluye tanto al trabajador principal como a los miembros inmediatos de la familia (c\u00f3nyuge e hijos solteros). Debe ingresar a Estados Unidos para continuar trabajando en su \u00e1rea de habilidad extraordinaria y su ingreso debe beneficiar sustancialmente al pa\u00eds de manera prospectiva.<\/p>\n<p>Para calificar como un <b>destacado profesor o investigador<\/b>, una persona debe (1) ser reconocida internacionalmente como destacada en un \u00e1rea acad\u00e9mica espec\u00edfica; (2) tener al menos tres a\u00f1os de experiencia en ense\u00f1anza o investigaci\u00f3n en el \u00e1rea acad\u00e9mica; <span style=\"text-decoration: underline;\">y<\/span> (3) buscar ingresar a Estados Unidos para ocupar un puesto permanente o con posibilidad de obtenerlo en una universidad u otro instituto de educaci\u00f3n superior para ense\u00f1ar en el \u00e1rea acad\u00e9mica.<\/p>\n<p>Un <b>ejecutivo o gerente multinacional<\/b> debe haber trabajado en el extranjero en dicha posici\u00f3n durante al menos uno de los tres a\u00f1os previos a su solicitud de clasificaci\u00f3n como trabajador prioritario y admisi\u00f3n a Estados Unidos como tal. Debe ingresar a Estados Unidos para trabajar como ejecutivo o gerente para la misma empresa, corporaci\u00f3n o entidad legal (o para una subsidiaria o afiliada de la misma) que lo emple\u00f3 en el extranjero.<\/p>\n<p><a name=\"4\"><\/a><\/p>\n<h4>EB-2 Profesionales con t\u00edtulos avanzados y personas de habilidades excepcionales<\/h4>\n<p>(28.6% del nivel mundial de visas, o aproximadamente 40,000 visas M\u00c1S visas no utilizadas de la categor\u00eda de trabajadores prioritarios, si las hay)<br \/>Estas visas est\u00e1n reservadas para inmigrantes calificados que son (1) miembros de profesiones con t\u00edtulos avanzados o su equivalente o (2) aquellos que tienen <a href=\"\/es\/personas-de-capacidad-excepcional\/\" target=\"_blank\" rel=\"noopener\">habilidades excepcionales en ciencias, artes o negocios<\/a>. Se requiere que tales inmigrantes beneficien sustancialmente la econom\u00eda nacional, los intereses culturales o educativos de Estados Unidos y que sus servicios sean solicitados por un empleador en el pa\u00eds.<\/p>\n<p>Al determinar si una persona tiene habilidades excepcionales, la posesi\u00f3n de un t\u00edtulo o licencia no constituye, por s\u00ed solo, suficiente evidencia de dicha habilidad.<\/p>\n<p>A diferencia de un trabajador prioritario, una persona puede inmigrar a Estados Unidos bajo esta categor\u00eda solo despu\u00e9s de que su empleador haya obtenido una certificaci\u00f3n laboral PERM para su puesto. El empleador debe demostrar que el requisito educativo m\u00ednimo para el puesto es un t\u00edtulo avanzado. Una persona con una licenciatura y cinco a\u00f1os de experiencia profesional puede considerarse que posee el equivalente a un t\u00edtulo avanzado.<\/p>\n<p>Sin embargo, cuando se considera que est\u00e1 en el <a href=\"\/es\/exencion-de-interes-nacional\/\" target=\"_blank\" rel=\"noopener\">inter\u00e9s nacional<\/a>, el USCIS puede eximir los requisitos de una oferta de trabajo y una certificaci\u00f3n laboral PERM.<\/p>\n<p><a name=\"5\"><\/a><\/p>\n<h4>EB-3 Profesionales, trabajadores calificados y no calificados<\/h4>\n<p>(28.6% del nivel mundial de visas, o aproximadamente 40,000 visas M\u00c1S visas no utilizadas de las dos categor\u00edas anteriores, si las hay)<br \/>Una persona es un profesional calificado bajo esta categor\u00eda si posee una licenciatura o experiencia equivalente y es miembro de profesiones.<\/p>\n<p>Un trabajador calificado es una persona capaz de desempe\u00f1ar una ocupaci\u00f3n que requiere al menos 2 a\u00f1os de capacitaci\u00f3n o experiencia, no de naturaleza temporal o estacional, y para la cual no hay trabajadores calificados disponibles en Estados Unidos.<\/p>\n<p>Otros trabajadores son aquellos que son capaces de realizar trabajos no calificados, no de naturaleza temporal o estacional, para los cuales no hay trabajadores calificados disponibles en Estados Unidos.<\/p>\n<p>Los trabajadores calificados, profesionales y otros trabajadores pueden inmigrar a Estados Unidos solo despu\u00e9s de que sus empleadores obtengan certificaciones laborales PERM para sus puestos.
